The Industrial Labour and Relations Court sitting in Nairobi has stopped the shambolic Kenya National Union of Nurses (Knun) elections that was scheduled for today amidst leadership row.
Justice Maureen Onyango ordered that the elections be suspended as well as registering new officials if the elections take place.
“That the application dated February 25, be certified and be fixed for mention before trial court for hearing on March 4th 2021,” reads in part of the court order.
Judge Onyango further directed that the elections should not be conducted until the matter is heard and determined.
“That should any elections be carried out, the interested party is restrained from registering any change of officials of the 2nd respondent arising from the elections scheduled for 26th February 2021 until further orders of this court,” Justice Onyango ordered.
Earlier, Knun had earlier suspended branch elections in 8 counties citing various reasons including lack of applicants, arrears in union dues of applicants, applicants were less than 2 and union membership was below 30 per cent to the total number of
However, after the ruling, Knun issued a statement saying the applicants of the petition failed to disclose to the court that the elections were already underway and several voters had already cast their votes.
The union in a letter through its lawyers Mayende and Busiega advised members to conclude the voting process and await further direction of the court.
