{"id":912,"date":"2020-06-22T13:35:58","date_gmt":"2020-06-22T13:35:58","guid":{"rendered":"https:\/\/countysplash.co.ke\/?p=912"},"modified":"2020-06-22T13:35:58","modified_gmt":"2020-06-22T13:35:58","slug":"walukegrace-wakhungu-found-guilty-of-sh297million-maize-scandal","status":"publish","type":"post","link":"https:\/\/horizonnews.co.ke\/?p=912","title":{"rendered":"Waluke,Grace Wakhungu found guilty of Sh297million maize scandal"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Bungoma <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By Tony Wafula <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sirisia MP John Koyi Waluke and Grace\nWakhungu, the mother of Ex- Environment Cabinet Secretary Judy Wakhungu have\nbeen found guilty in the Sh297million fraud case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The two were found guilty of defrauding\nthe National Cereals and Produce Board (NCPB) Sh297 and have been remanded at\nKileleshwa Police station awaiting their sentence on June 25.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The court found that there was\nfraud and the accused acquired money by false pretences,&#8221; stated Elizabeth\nJuma, a magistrate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last month, he also failed an attempt\nto stop their trial, which was dismissed by Justice Mumbi Ngugi.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"747\" height=\"518\" src=\"https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/06\/zynefcbgri8gb35b635904057ec.jpg\" alt=\"\" class=\"wp-image-913\" srcset=\"https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/06\/zynefcbgri8gb35b635904057ec.jpg 747w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/06\/zynefcbgri8gb35b635904057ec-300x208.jpg 300w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/06\/zynefcbgri8gb35b635904057ec-218x150.jpg 218w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/06\/zynefcbgri8gb35b635904057ec-696x483.jpg 696w\" sizes=\"auto, (max-width: 747px) 100vw, 747px\" \/><figcaption><strong><em>Sirisia MP John Waluke<\/em><\/strong><\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf storage charges were based on a\nfraudulent document it may well be that no maize had been ordered and the award\nin respect to the alleged loss of profit may also have been unmerited and\ntherefore a fraudulent acquisition of public funds,\u201d reads part of Justice\nMumbi ruling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling also reads \u201cIn the\ncircumstances, this case does not qualify as one of the clear cases in which\nthe court can be satisfied that the prosecution does not have a proper legal\nand factual foundation to mount a prosecution,\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case involves Wakhungu, a\ndirector of Erad, and MP Walukhe who is accused of uttering a false document.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"928\" height=\"1024\" src=\"https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/03\/IMG-20200305-WA0010-928x1024.jpg\" alt=\"\" class=\"wp-image-403\" srcset=\"https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/03\/IMG-20200305-WA0010-928x1024.jpg 928w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/03\/IMG-20200305-WA0010-272x300.jpg 272w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/03\/IMG-20200305-WA0010-768x847.jpg 768w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/03\/IMG-20200305-WA0010-696x768.jpg 696w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/03\/IMG-20200305-WA0010-1068x1178.jpg 1068w, https:\/\/horizonnews.co.ke\/wp-content\/uploads\/2020\/03\/IMG-20200305-WA0010.jpg 1146w\" sizes=\"auto, (max-width: 928px) 100vw, 928px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">They were charged over a contract that the company won to supply 40,000\ntonnes of maize in 2004.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the prosecution, Waluke and Wakhungu fraudulently acquired the\nmoney as costs of storage allegedly incurred by Chelsea Freight, loss of\nprofits and interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If he is convicted and does not appeal the ruling, he\nrisks losing his Sirisia MP seat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ends<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bungoma By Tony Wafula Sirisia MP John Koyi Waluke and Grace Wakhungu, the mother of Ex- Environment Cabinet Secretary Judy Wakhungu have been found guilty in the Sh297million fraud case.
