The MP is facing murder charges after he allegedly shot dead, Brian Olunga, a bodyguard to his opponent<\/code><\/strong><\/p>\n\n\n\n

Kimilili MP Didmus Barasa\nhas been freed on Sh10million bond by the Kakamega High Court.<\/p>\n\n\n\n

This is after the\nMP elect pleaded not guilty to the murder of Brian Olunga.<\/p>\n\n\n\n

He is facing murder\ncharges after he allegedly shot dead, Brian Olunga, a bodyguard to his\npolitical rival in the just concluded general elections.<\/p>\n\n\n\n

Justice Patrick\nOtieno warned the MP elect on the revocation of the bond if he fails to follow\nstrict conditions stated by the court .  <\/p>\n\n\n\n

\u2018\u2019He should not comment on proceedings of the case anywhere, may it be TV, radio, funerals or any public gathering. Violation of the condition shall lead to cancellation of the bond.\u2019\u2019 said Otieno <\/code><\/strong><\/p><\/blockquote>\n\n\n\n

\u2018\u2019Since he is the\nformer MP and MP elect he has great influence in Kimilili where he committed\nthe offence, to protect the family and witnesses Didmus must submit his guns\nand passport to DCI within 48hrs,\u2019\u2019 Otieno said  <\/p>\n\n\n\n

In addition, Otieno\nordered the MP elect not to be seen near Kimilili constituency or Bungoma\nCounty at large until 23 witnesses against him have recorded their statement\nagainst him. Also not to contact any witness in the pending period of\ndetention.   <\/p>\n\n\n\n

\u2018\u2019He should not comment on proceedings of the case anywhere, may it be TV, radio, funerals or any public gathering. Violation of the condition shall lead to cancellation of the bond.\u2019\u2019 said Otieno <\/p>\n\n\n\n

His lawyers pleaded\nwith the court to allow the MP elect access to his home in Kimilili to get\npersonal effects and even his certificate from the Independent Electoral and\nBoundaries Commission (IEBC), Bungoma for winning the Kimilili parliamentary\nseat.<\/p>\n\n\n\n

\u2018\u2019He may visit his\nhome for only 3 hours on a date that will be arranged by the DCI and his\nlawyers. He will only be allowed to address not more five people during his\nvisit.\u2019\u2019 Said Otieno <\/p>\n\n\n\n

In the morning\nsession Barasa pleaded not guilty to murdering Brian Olunga on 9th<\/sup>\nAugust at Chebukwabi village in Kimilili, Bungoma County.<\/p>\n\n\n\n

At the time of\ndeath, Olunga, 21, was a bodyguard to Brian Khaemba, who was vying for the\nKimilili parliamentary seat on DAP-K ticket against Barasa.<\/p>\n\n\n\n

Peter Kiprop and\nGrace Mukungu, who are state lawyers, demanded that the MP be given a tough\nbond and ensure he attends all court proceedings without fail and not to temper\nwith any witnesses due to the seriousness of the offence he has committed. <\/p>\n\n\n\n

\u2018\u2019 We pray that if\nthe court grants him bail he subsequently surrenders his gun, passport and\npledges not to interfere or contact witnesses in the case,” said Ms\nMukangu.<\/p>\n\n\n\n

They additionally\nsaid that the MP’s duties entailed traveling out of the country frequently and\nwithdrawal of his passport would affect his delivery of services to Kimilili\nresidents.<\/p>\n\n\n\n

They also argued\nthat earlier on the MP surrendered himself to the police at Kimilili and that\nhe should be treated leniently. <\/p>\n\n\n\n
