It must be understood that an industrial\ndesign does not protect the method of construction or the function of the\narticle.<\/li><li>Visual appeal is one of the\nconsiderations that influence the decision of consumers to prefer one product\nover another, particularly in areas where a range of products performing the\nsame function is available in the market. If the technical performance of the\nvarious products offered by different manufacturers is relatively equal,\naesthetic appeal, along with cost, will determine the consumer&#8217;s choice.<\/li><li>An industrial design registered in\nKenya does not give protection abroad. Industrial designs\nmade in execution of commission or by an employee<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Unless there is a contractual\nprovision to the contrary, the right to an industrial design made in execution\nof a commission or of an employment contract shall belong to the person that\nhas commissioned the work or the employer.
